Drug Possession

It is unlawful for any person knowingly or intentionally to possess a controlled substance unless the substance has, a valid prescription. It is described under Virginia Code 18.2-250.

Drug Possesion can either be a class 5 felony or a misdemeanor Class 1-5.

The nature of the substances will determine whether you are charged with a minor misdemeanor or felony.
